Who this is for: companies and sole traders who have accepted an invitation to test HUBAL free of charge. The terms below supplement the Terms of Service and the B2B Annex — everything else applies unchanged. In the event of a conflict these terms prevail, but only for the duration of the testing period.
Who accepts: the organisation's administrator, once, on behalf of the whole team. We record the acceptance together with its date and the document version.
§1. What the programme is
1. We make HUBAL available free of charge in order to collect feedback on how the product works before its full rollout. This is neither a trial of a paid subscription nor a promotion — it is joint work on the product.
2. The programme runs until further notice. We may end it at any time, giving at least 14 days' notice to the e-mail address of the organisation's administrator. A participant may withdraw at any time, without giving a reason and at no cost.
3. When testing ends the account does not disappear: it moves to the Free plan under the Terms of Service. Data remains available and exportable, and moving to a paid plan is voluntary.
§2. The nature of a test release
1. The participant acknowledges that they are testing software under development. It may contain errors, gaps and unfinished features; outages, changes or withdrawal of features may occur, and in extreme cases so may loss or corruption of data.
2. During the testing period no guaranteed availability levels (SLA) and no response times from the B2B Annex apply.
3. The participant therefore undertakes not to entrust HUBAL with the only copy of data whose loss would be damaging to them, and to keep their own backups of documentation critical to their business.
4. We recommend not entering data subject to special protection during the testing period (including special categories of data within the meaning of Article 9 GDPR) unless it is necessary in order to test a feature.
§3. Liability
1. Because the service is provided free of charge and is of a testing nature, the participant will not pursue claims relating to defects in operation, outages, loss of data or lost profits arising from the use of the test release.
2. Our liability during the testing period is excluded to the fullest extent permitted by law. We do not, however, exclude or limit liability for: damage caused intentionally, personal injury, and in any other case where mandatory provisions of law do not allow it — in particular as regards the protection of personal data (GDPR) and liability towards consumers.
3. This section applies only to the period of free testing. After a move to a paid plan, liability is governed by the Terms of Service and the B2B Annex on general terms.
§4. Ceiling on free use
1. Free participation has an upper usage limit counted for the entire organisation — regardless of how many people use it. The testing package is as follows:
| What | How much | Note |
|---|---|---|
| Team seats | 10 people | For a larger team, write to us before the start and we will raise it. |
| AI credits | 12,000 per month | For the whole organisation. The same amount the Start plan gives a ten-person team. |
| File storage | 20 GB | For the whole organisation, including mail attachments. |
2. These figures apply to every participant in the programme — we do not negotiate them individually, apart from the number of seats for larger teams. Current usage is visible in the app under Settings → Subscription. We give 14 days' notice of any reduction; increases are applied immediately.
3. Once the pool is used up, AI features and file uploads are paused until the beginning of the following month. A top-up package of credits or storage can always be purchased under the Price List — this is voluntary and does not end participation in the programme.
4. The ceiling protects both sides: it lets us invite more companies to test, and it lets the participant use the product without the risk of an unexpected bill.
§5. Contact about testing, and surveys
1. The participant consents to e-mail contact on matters connected with the testing: questions about their experience of particular features, surveys, information about changes and invitations to talk. This is a condition of participation — testing without feedback serves no purpose.
2. We make contact solely on matters concerning the testing programme. The consent does not cover marketing of other products, nor passing the address to third parties.
3. Answering surveys is voluntary. Consent to contact may be withdrawn at any time by writing to support@hubal-project.com — withdrawing it ends participation in the programme and moves the account to the Free plan (data remains).
4. The basis for processing contact data is performance of the agreement on participation in the testing (Article 6(1)(b) GDPR) and our legitimate interest in developing the product (Article 6(1)(f) GDPR). Details — Privacy Policy.
§6. Feedback, reports and confidentiality
1. We may freely use comments, suggestions and bug reports submitted as part of the testing to develop the product, without remuneration and without any obligation to name the author. This does not apply to the participant's data and content — those remain theirs under the Terms of Service.
2. Features made available only in testing and not yet publicly released are to be treated as confidential by the participant until their public launch. This does not apply to opinions about the product — those may be expressed freely.
§7. Personal data
1. Data entered into HUBAL by the participant is processed by us as a processor, on the terms of the Data Processing Agreement (DPA). The testing period changes nothing here — the processor's obligations and the rights of data subjects are the same as on paid plans.
2. The controller of the participant's contact data is ANTONI SUROWIAK EMA STUDIO, ul. Westerplatte 6, 38-200 Jasło, Poland, e-mail: legal@hubal-project.com.
§8. Final provisions
1. We give 14 days' notice of changes to these terms, on the basis set out in the Terms of Service. A new version requires fresh acceptance by the organisation's administrator; without acceptance, participation in the testing ends and the account moves to the Free plan.
2. Matters not regulated here are governed by the Terms of Service, the B2B Annex and Polish law.
